OneBella™ Terms of Service

1. Acceptance of Terms

By accessing or using OneBella™ ("the Service," "our App," "the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

OneBella™ is a comprehensive diabetes management platform designed to help users track glucose levels, monitor food intake, and receive AI-powered health insights. This Service is intended for informational and educational purposes and should supplement, not replace, professional medical care.

⚠️ Important Medical Disclaimer

OneBella™ is NOT a medical device and should not be used as the sole basis for medical decisions.

  • Consult Healthcare Providers: Always consult with qualified healthcare professionals before making any changes to your diabetes management plan
  • Emergency Situations: In case of medical emergencies, contact emergency services immediately
  • Traditional Monitoring: Continue using your prescribed glucose monitoring devices as directed by your healthcare provider
  • AI Limitations: AI predictions and recommendations are based on data patterns and should be verified with actual glucose readings

2. User Eligibility and Age Requirements

Age Restrictions

  • Children 5–12 (Kid Mode): May use the Service with verified parental consent. COPPA-compliant — parents must complete the consent workflow before the child's account is activated. Community, GPS, and messaging features are restricted at the backend.
  • Teens 13–17 (Teen Mode): May use the Service with parental consent. Age-appropriate content moderation and community restrictions apply.
  • Adults 18+ (Adult Mode): May use the Service independently with full platform access.
  • Children under 5: Not permitted to use the Service.

Health Requirements

  • Users must have been diagnosed with diabetes or be under medical supervision
  • Users with certain medical conditions should consult healthcare providers before use
  • The Service is not intended for use during pregnancy without medical approval

3. User Accounts and Responsibilities

Account Security

  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • You agree to provide accurate and current information when creating your account

Prohibited Uses

You agree NOT to:

  • Share medical data belonging to others without consent
  • Use the Service for illegal activities
  • Attempt to reverse engineer or hack the platform
  • Share your account credentials with others
  • Upload harmful, offensive, or inappropriate content

4. AI and Machine Learning Features

AI Capabilities

  • Glucose Predictions: Machine learning models predict trends up to 6 hours
  • Food Analysis: Computer vision analyzes food photos for carbohydrate estimation
  • Pattern Recognition: AI identifies trends in your glucose and lifestyle data
  • Voice Processing: Speech-to-text for hands-free data entry

AI Limitations

  • AI predictions are estimates based on historical data patterns
  • Accuracy may vary based on individual factors and data quality
  • AI recommendations should always be verified with healthcare providers
  • Machine learning models improve over time but are not perfect

5. Third-Party Device Integrations

Connected Devices

OneBella™ may integrate with third-party devices and services, including but not limited to Dexcom continuous glucose monitors (CGM) and Garmin wearable devices. These integrations are provided for convenience and informational purposes only.

Device Disclaimers

  • Third-Party Products: Dexcom, Garmin, and any other connected devices are products of their respective manufacturers. OneBella LLC is not affiliated with, endorsed by, or responsible for these third-party products.
  • Accuracy: OneBella LLC does not guarantee the accuracy, reliability, or availability of data received from third-party devices. Sensor readings, heart rate data, and other device metrics may contain errors or delays.
  • Outages: OneBella LLC is not responsible for service interruptions, data gaps, or outages caused by third-party device manufacturers or their platforms.
  • Medical Verification: Always verify glucose readings from connected devices with a traditional blood glucose meter before making treatment decisions.

6. Community Features, T1 Nearby™, and Messaging

User-Generated Content

OneBella™ includes community features such as T1 Nearby™ (location-based discovery of other T1D users), community posts, and direct messaging. By using these features, you agree to the following:

  • User Responsibility: You are solely responsible for the content you post, share, or send through community and messaging features. Do not share medical advice — only licensed healthcare professionals should provide medical guidance.
  • No Accuracy Guarantee: OneBella LLC does not verify, endorse, or guarantee the accuracy of any information shared by other users in community posts, messages, or nearby profiles.
  • Content Moderation: OneBella LLC reserves the right to review, remove, or restrict any content or user account that violates these Terms, contains harmful or inappropriate material, or endangers other users — especially minors.
  • Reporting: Users may report inappropriate content or behavior. OneBella LLC will review reports and take appropriate action, which may include content removal or account suspension.

Location and Visibility (T1 Nearby™)

  • Opt-In Only: Location sharing and community visibility are entirely optional. You control whether you appear on the T1 Nearby™ map through your privacy settings.
  • No Guarantee of Others: OneBella LLC does not verify the identity, location accuracy, or intentions of other users visible on T1 Nearby. Exercise caution when interacting with other users, especially in person.
  • Child Restrictions: Users under 13 (Kid Mode) are blocked from community, messaging, and T1 Nearby features at both the backend API and frontend interface level.

7. Privacy and Data Protection

  • Encryption: All health data is encrypted using AES-256 medical-grade encryption
  • HIPAA Compliance: We follow HIPAA guidelines for protected health information
  • No Data Selling: We never sell your personal or health data to third parties
  • User Control: You can export or delete your data at any time

8. Data Retention

We retain your personal and health data only as long as necessary to provide the Service and fulfill the purposes described in our Privacy Policy. Specifically:

  • Active Accounts: Data is retained for the duration of your active account.
  • Account Deletion: Upon account deletion request, your personal data and health records are permanently deleted within 30 days. Anonymized, aggregated data may be retained for research purposes.
  • Age Verification Data: Date of birth is used solely to determine age group eligibility (Kid, Teen, Adult) and enforce COPPA protections. It is not shared with any third party.
  • Legal Obligations: We may retain certain data as required by law or to protect our legal rights.

9. Parent and Guardian Responsibilities

If you create or manage a child's account on OneBella™:

  • Supervision: You are responsible for supervising your child's use of the Service and ensuring they use it appropriately.
  • Consent Renewal: COPPA parental consent must be renewed periodically. You will receive notifications before consent expires.
  • Data Decisions: You are responsible for deciding what health data is entered and shared through your child's account.
  • Account Management: You may review, modify, or delete your child's data and account at any time through the parental controls dashboard.

10. No Emergency Use

OneBella™ is not designed for use in medical emergencies. If you or someone you are caring for is experiencing a medical emergency — including but not limited to severe hypoglycemia, diabetic ketoacidosis (DKA), loss of consciousness, or any life-threatening situation — call emergency services (911 in the United States) immediately. Do not rely on OneBella™ to alert emergency responders or provide emergency medical guidance.

11. Service Availability

We strive to provide reliable service, but we cannot guarantee 100% uptime. The Service may be unavailable due to maintenance, updates, or technical issues. We are not liable for any damages resulting from service interruptions.

12. Limitation of Liability

OneBella™ is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, OneBella LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses resulting from:

  • Your use of or inability to use the Service
  • Any medical decisions made based on information provided by the Service or its AI features
  • Any errors, inaccuracies, or delays in data from connected third-party devices
  • Any content posted by other users in community or messaging features
  • Unauthorized access to or alteration of your data
  • Any health outcomes related to diabetes management decisions

Users assume full responsibility for their diabetes management decisions. OneBella™ supplements — but never replaces — professional medical care.

13. App Distribution and App Store Terms

OneBella™ will be available at launch in 2026 as a web application that runs in any modern browser, and is also coming to the Apple App Store and Google Play at launch. It is not yet available for download from the app stores.

  • Store Providers Are Not Parties: If you obtain OneBella™ through the Apple App Store or Google Play, Apple Inc. and Google LLC are not parties to these Terms, have no obligation to provide support or maintenance for the Service, and are not responsible for the Service or its content.
  • Store Rules Apply: Your use of an app-store version of OneBella™ is also subject to the applicable store's terms of service and usage rules.
  • Same Platform: The web, iOS, and Android versions of OneBella™ connect to the same platform and account — these Terms apply equally regardless of how you access the Service.

14. Modifications to Terms

OneBella LLC reserves the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Maine, United States, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of the State of Maine.

If you use the Service as a consumer in the European Union, United Kingdom, or another jurisdiction with mandatory consumer protection laws, nothing in these Terms limits any non-waivable rights you have under the laws of your country of residence.
